Terms of sale

In short: on Whatnot, Voggt and Cardmarket, the platform’s terms apply. These terms cover sales made directly with me: Instagram direct message, email or hand delivery in Paris. This translation is provided for convenience; the French version prevails.

02 Scope

These terms of sale apply to sales concluded directly between DAMDAMCARDS and a buyer (“the customer”): orders by Instagram direct message, by email, or hand delivery in Paris.

Purchases made on Whatnot, Voggt and Cardmarket (live auctions and shops on those platforms) are subject to each platform’s own terms, which handle the order, payment and any disputes.

The damdamcards.com website is a showcase: no orders are placed on it. Business customers are invited to contact me before ordering.

03 Items

DAMDAMCARDS sells collectible Pokémon cards, mostly Japanese and vintage: single cards, graded cards and sealed products. Most are second-hand collectibles, often one-of-a-kind, offered while stocks last.

Before ordering, the customer receives the item’s key characteristics: name, set, language, condition (Mint, Near Mint, Excellent…) with a description of visible flaws, and photos or video of the actual item sold. The condition visible in the photos is part of the description.

The grade of graded cards is given by an independent grading company (PSA in particular) and is its sole responsibility; the certificate number lets you check it on its website.

04 Prices

Prices are given in euros, all taxes included, in the exchange preceding the order, together with any shipping costs. The applicable price is the one confirmed at the time of the order.

05 Order

The customer names the card(s) they want. DAMDAMCARDS confirms in writing (direct message or email) availability, condition, price, costs and delivery time or hand-delivery arrangements. The sale is concluded when the customer accepts this summary and pays.

A card may be sold at the same time on another channel (live show, platform). If an item turns out to be unavailable after payment, the customer is informed without delay and fully refunded within 14 days at the latest.

06 Payment

• Online payment, by bank transfer, PayPal or bank card (secure Qonto or Revolut Business payment link). DAMDAMCARDS never has access to your full card details.
• Hand delivery in Paris: payment at handover, by the method agreed in advance.

For deliveries, the item ships once payment has been received.

07 Delivery and hand delivery

Delivery. Items ship to the address given by the customer, in France and abroad, usually within 24 to 48 business hours, with a tracking number. Cards travel in a sleeve and toploader, in protective packaging. The announced delivery time cannot exceed 30 days; if it is late, the customer may ask for delivery within a reasonable extra period and, failing that, cancel the order and be refunded.

The risk of loss or damage passes to the customer when they physically take possession of the parcel. If a parcel arrives damaged, please note it with the carrier and email me within 48 hours with photos. Outside the European Union, any import duties and taxes are payable by the customer.

Hand delivery. Available in Paris, in a public place at a time agreed by direct message. The customer may examine the card before taking it; risk passes at handover.

08 Right of withdrawal

For a distance sale (direct message, email), a consumer customer has 14 days from receipt of the item to withdraw, without giving any reason or paying any penalty.

They inform me of their decision by a clear statement to contact@damdamcards.com, for example using the form below, then return the item within 14 days to the address sent by email. Return costs are borne by the customer; tracked and insured shipping is recommended.

DAMDAMCARDS refunds all sums paid, including the initial delivery costs (standard rate), within 14 days of being informed of the withdrawal. The refund may be withheld until the item is received or proof of return is provided, and is made using the original payment method.

The customer may be held liable for any loss in value resulting from handling beyond what is needed to establish the item’s nature and characteristics (bent or marked card, opened or cracked grading case, opened sealed product): this loss may be deducted from the refund.

09 Legal guarantees

All items benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Under the guarantee of conformity, the customer has 2 years from delivery to act. For second-hand goods, a defect appearing within 12 months of delivery is presumed to have existed at delivery (24 months for new goods). The customer may obtain repair or replacement, or failing that a price reduction or cancellation of the sale. For hidden defects, action may be taken within 2 years of discovering the defect.

10 Complaints and mediation

For any question or complaint: contact@damdamcards.com. If a dispute is not resolved after a written complaint, a consumer customer may use a consumer mediator free of charge (articles L.612-1 et seq. of the French Consumer Code), whose details will be given here.

11 Personal data

Data exchanged for an order (name, address, email, messages) is used only to process, ship and invoice it. See the privacy policy.

12 Force majeure

DAMDAMCARDS cannot be held liable for failing to perform its obligations in a case of force majeure within the meaning of article 1218 of the French Civil Code (including strikes or disruption of postal and transport services).

13 Governing law and disputes

These terms are governed by French law. An amicable solution is sought first. Failing that, a consumer customer may bring proceedings, at their choice, before the court of the place where they lived at the time of the order or of the harmful event, or any other court with jurisdiction under the law.

14 Changes

DAMDAMCARDS may change these terms at any time. The applicable terms are those in force on the date of the order.
